General Competition Terms & Conditions 

Terms & Conditions:

Any promotional claim is deemed acceptance of these terms and conditions.

  1. Information on how to enter this competition (Competition) forms part of the terms of entry, which includes these terms and conditions (Terms). Entry into the competition is deemed acceptance of these terms.
  2. This competition is run by Accent Tools Ltd of Private Box 302 012, North Harbour, Auckland 0751 (Promoter).

Entry into HiKOKI Competitions as a General.

  1. Entry into the Competition is open to New Zealand citizens and New Zealand residents only over 18 years of age.
  2. All HiKOKI Competitions have a commence date and a closing date stipulated on the terms and conditions of the promotion that validated the promotional period. Please Note: The Competition start date and end date or the entire Promotion Period may be changed at any time and at short notice due to the current restrictions enforced by the New Zealand Government in relation to the Covid-19 crisis. The Promoter may also vary the Promotion Period at any time taking into account the Covid-19 crisis.
  3. To enter, entrants must, during the Competition Period complete the following instructions, this may include Purchase any/or a particular HiKOKI Power Tool product, from any Authorised HiKOKI retailers during the promotional period and retain your proof of purchase (receipt). HiKOKI products purchased from non-authorised sellers and retailers (including parallel imports) are not eligible to participate in this Competition. The items must be paid for in full and account with dealers or retailers cannot be in arrears or default. Entry into any Competition is by completing an online entry form only as set out below or participating in a task outline on any official social media sites managed by Accent Tools in conjunction with HiKOKI NZ. If instructed as part of the competition to visit www.hikoki.co.nz and complete the entry form, you must do so and must include: Full Name (first name and last name); Company name (not mandatory); Email address; Mobile number; Address; Authorised HiKOKI retailer – place of purchase; Receipt/Invoice number of eligible purchases made during the Promotional period; and Number of eligible entries (1 entry per invoice). The winner will be notified by phone after their entry has been confirmed as genuine after validating the purchase receipt and details with the Authorised HiKOKI retailer store. Any entry form/application that fails to provide true and correct information will be deemed invalid and excluded from the Competition. The Promoter will collect the winner’s address details so that the prize can be awarded. Entrants are responsible for any expenses they incur in entering the Competition. There is no additional fee charged to enter this Competition other than the cost of the HiKOKI product purchased and the cost of you accessing the Internet.
  4. If an entrant is entering on behalf of a Company or Business, and not in their own right, consent must be obtained from the Company or Business whom is making the HiKOKI product purchase. If an entrant is an employee or contractor of a Company or Business and is making the purchase on behalf of a Company or Business, or the purchase is under a corporate account, consent must be obtained from the Company or Business (that is the actual purchaser) that is making the HiKOKI product purchase. If entrants are entering as a result of a HiKOKI product purchase made through a Company or Business account, consent must be obtained from the Company/Business for an entry to be valid. Entrants must have the express written consent of the Company or Business on or before entering the Competition, in order for the entry to be valid for this Competition. The promoter may request a written copy of this consent, at any time.
  5. For draw/submissions to be validated, Entries must be received by 11.59pm (NZST) on the stipulated date (close off date). Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant. Entries must be received by the respected Closing Date. The Promoter accepts no responsibility for any late, lost, or misdirected entries due to technical disruptions, network congestion, or for any other reason.
  6. Multiple entries are not eligible per receipt unless stipulated within the terms and conditions of the promotion.
  7. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s retailers associated with this promotion, and each of their immediate families (i.e. spouse, parent, child, or sibling) are ineligible to enter.
  8. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms or who has, in the sole opinion of the Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. This includes but is not limited to entrants and households using multiple email addresses, postal addresses, PO Box addresses to register single or multiple purchases.
  9. Entrants warrant that their entry in the Competition does not breach the intellectual property rights of any third party nor breach the Gambling Act 2003. The entrant indemnifies and will keep the Promoter and its associated agencies indemnified against any loss, costs (including legal costs), expenses, or liability the Promoter and its associated agencies may suffer arising out of any breach by the entrant of this clause.

Determining the Winner of the Prize Pack

  1. The prize draw for each competition will take place at HiKOKI Head Office NZ, 232 Bush Road, Rosedale, Auckland NZ on the (10) tenth business day after the closed date stated in section (7) of these terms and conditions. One winner(s) will be awarded the prize within 6 weeks of the prize draw. The winner will be required to provide a physical delivery address to be presented with the prize. The winner(s) will be notified by phone, email and published on http://www.hikoki.co.nz/ within 5 days of the draw (or earlier). Further prize confirmation will be sent to the winner within 4 weeks of the draw.
  2. Each prize pack will stipulate what is included in the prize pack and will document the product codes included in this prize pack. Values used for promotional and representation purposes will always be displays as RRP (Recommended Retail Price) and including GST; Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). All references to currency are to NZ currency. The promoter accepts no responsibility for a change in prize value. All prize values are listed in NZ currency. Prize images are for illustrative purposes only and some staging accessories and decorative items may not be included in the prize.
  3. If the winner is, through any legal incapacity or otherwise, unable to register the prize in their own name, then the winner may assign the prize to another person (who consents to such assignment) with legal capacity for the purposes of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee.
  4. Terms & Conditions of that unique competition being promoted will stipulate how many prize quantities will be given away and how many winners in total. Each promotion will vary depending on the conditions of that promotion.
  5. For marketing purpose only we may choose to promote a Total Maximum Prize Pool Value with an approximately valued at Recommended Retail Value (including GST).
  6. If within 4 weeks the prize is not claimed by the winner, a draw for any unclaimed prizes if required may take place on a later date at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner will be notified by phone, email, and published on www.hikoki.co.nz within 5 days of the draw.
  7. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  8. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal or greater value and/or specification, subject to any written directions from a regulatory authority.
  9. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  10. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.
  11. The Promoter reserves the right to request the winner to provide proof of identity and proof of residency at the nominated prize delivery address such as driver’s license, photo ID, passport, and other similar documentation. Proof of identification, residency, and entry considered suitable for verification may be requested at the sole discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  12. The prize pack will be awarded to the person named in the entry only unless assigned via the winner (refer to clause 14). Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter and modify their entry as appropriate.
  13. 25. If the winner advises that they do not want to accept the prize, it will be forfeited and awarded to another winner.
  14. 26. Unless expressly stated in these Terms all other expenses become the responsibility of the winner.
  15. Once the prize has left the Promoter’s nominated premises, the Promoter takes no responsibility for prize being damaged, delayed, or lost in transit. Prize confirmation will be sent out within 28 days. Please allow up to six (6) weeks for prize delivery or collection.
  16. By accepting the prize, the winner agrees to participate in and cooperate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed and/or filmed.
  17. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  18. The winner should seek independent financial advice as tax implications may arise as a result of accepting the prize.
  19. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in clause 10 or is in breach of these Terms.
  20. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize pack and the prize pack supplier’s requirements.

General Conditions

  1. In the case of: – The intervention of any outside act, agent, or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these Terms, including but not limited to vandalism, disease pandemic, power failures, tempests, natural disasters, acts of God, civil unrest, pandemic, strike, war, the act of terrorism; or – The Promoter being unable to run the Competition as planned due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter may in its absolute discretion take any action that may be available and it deems appropriate (at its sole discretion), including changing the Promotion Period of the Competition and to cancel, terminate, modify or suspend the Competition.
  2. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize pack except for any liability which cannot be excluded by law (including the Fair Trading Act 1986 and the Commerce Act 1986). The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  3. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms, or engaged in any unlawful or other improper misconduct of the Competition. The Promoter reserves its rights to recover damages or other compensation from such a person.

Collection of Information

  1. In the case of:
    • The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at: here
    • The Promoter is bound by the Privacy Act 1993 and by entering the Competition, an entrant is taken to consent to the Promoter’s Privacy Policy.

In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the New Zealand Privacy Act or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of New Zealand including in Australia and Japan.

Media & Marketing

  1. The prize winner agrees to participate in any news media activities surrounding the Competition. The Promoter reserves the right to use the winner’s name, voice, image and likeness for marketing, advertising and publicity purposes in any media in perpetuity without further reference, payment or other compensation to the winner.
  2. Each entrant also consents to the Promoter using their personal information for future marketing purposes, unless otherwise advised by the entrant.

Tax

  1. Any tax liability arising as a result of accepting the prize is the responsibility of the winner

Governing Laws

  1. The laws of New Zealand apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New Zealand

Important information on your HiKOKI Warranty

Terms and conditions of your HiKOKI Product Warranty.

Thank you for purchasing a HiKOKI Product. Most HiKOKI product comes with a HiKOKI (3) Year Warranty*. As you may know, recent changes apply to the Product Warranty provided with HiKOKI and Hitachi Power Tools purchased by a Consumer after 1st October 2018. The HiKOKI Warranty Policy document is provided with the purchase of your HiKOKI product and may not take into account these recent changes. This warranty is offered in addition to rights provided to the purchaser by National Statutes and Legislation. To view a copy of your warranty card, click here.

Terms and conditions of your HiKOKI Warranty

Important Note: It is the owner’s responsibility to ensure all necessary maintenance is undertaken and normal operating procedures are adhered to. Damage or failure caused by lack of maintenance or misuse is outside the scope of the warranty policy. It is highly recommended that a regular Maintenance Plan is entered into utilising the expertise of an Authorised Service Agent in order to maximise the life of any equipment.

HiKOKI Power Tools and HiKOKI Outdoor Power Equipment are warranted against defective workmanship and faulty materials for a period of three (3) years from the date of purchase.*

In the event of a repair being required within the warranty period, the tool will be repaired without charge on the condition that:

The purchaser produces the original invoice or other purchase document as proof of date of purchase from an Authorised New Zealand HiKOKI Distributor.

And that

  • The complete tool is delivered to an Authorised Hikoki Service Agent, freight prepaid, and if found, on examination, to be suffering from a material or assembly defect.
  • The tool has been used in strict accordance with the Operating Instructions supplied with  the tool, and has been operated under normal conditions. For Electric Tools this includes operating the tool with the correct 230/240 Volt power supply at all times.
  • The repairs are not required as a result of normal wear and tear, or as a result of accident, misuse, neglect, or abuse of the tool. Overloading of the tool beyond its capacity, causing  burnout of the motor, armature and/or field coil is not covered by warranty.

In the instance of Outdoor Power Equipment, misuse includes:

  1. Operation of product with incorrect fuel to oil ratio
  2. Accident or physical damage, or damage caused by moisture, dirt, or corrosion
  3. Repairs by unauthorised parties and/or with unauthorised parts
  4. Improper set up or alterations
  5. Improper adjustments i.e. carburettor, etc.
  6. Operation of engine at speeds above HiKOKI recommendations
  7. Failures due to contaminated and/or old fuel

Products & applications excluded from the 3 year warranty period:

Lithium Ion Batteries, MULTI VOLT Batteries, Battery Chargers, AC Power Adaptor (ET36A) – 2 Year Warranty

NiCd Batteries  – 1 Year Warranty

Powertool accessories: bags, cases, work lights, radio, Power Adapters, Heat Guns etc. – 1 Year Warranty

Benchtop Tools – Mitre Saws, Table Saws, Thicknessers, Rebar Bender Cutters etc. – 1 Year Warranty

Outdoor Power Equipment used in commercial applications – 1 Year Warranty

This warranty is offered to the original purchaser of the tool only. Tools operated in a Hire environment are not covered by this warranty. Normal wearing parts requiring replacement or adjustment are not covered by this warranty.

These parts include but are not limited to: o-rings, seals, bearings, carbon brushes, power leads, fuses, drive belts, hoses, spark plugs, starter cord, air and fuel filters, clutch shoes, vibration isolators, throttle cables, cutting chains, blades, driver bits, sockets, chucks, sanding pads and all cutting accessories.

Normal wear and tear includes cordless tool batteries that have come to the end of their useful life. Normal adjustments to the blades, laser markers, guards, chain, points, magneto, carburetor and spark plugs are the responsibility of the owner and are not considered part of this warranty.

This warranty is offered in addition to rights provided to the purchaser by national Statutes and Legislation.

The liability of HiKOKI and its National Distributor, Accent Tools Ltd, is limited to the repair of the tool and in no event will any liability be accepted for any direct, indirect, or consequential losses or damages whatsoever. Tools that have been Parallel Imported are not covered by this warranty and will not be supported by HiKOKI Service Agents.

Additional requirements for Outdoor Power Equipment:

It is a condition of the sale that the purchaser receives from the HiKOKI Dealer an explanation of the following information, as outlined in the Owners Manual:

  • The tools basic features and operational capability
  • Routine maintenance requirements
  • Safe operation of the tool including appropriate Personal Protective Equipment that should be used

Terms and conditions of HiKOKI Redemptions

  1. To make a claim for a redemption promotional offer, you must accept all terms and conditions stated below the redemption form and complete this form in its entirety. Click here to submit your redemption –  Redemption Form. To claim the bonus redemption item you must submit the required information via the online redemption form and must include proof of purchase, and upload a photo of the barcode featured on the packaging and either email this to redemption@hikoki.co.nz or use the online redemption form using this url www.hikoki.co.nz/redemption-form/ and upload the required information. Goods must be shown on one receipt to be eligible.
  2. HiKOKI reserves the right to verify the validity of all claims and disqualify any claimant for tampering with the claim process or for submitting a claim which is not in accordance with these Terms and Conditions.  Only one claim permitted per purchase.
  3. Please allow 6 weeks for delivery of bonus item.
  4. The bonus item is not transferable or exchangeable and cannot be taken as cash.
  5. Not available in conjunction with any other HiKOKI redemption or promotional offer.
  6. Except for any liability that cannot be excluded by law, HiKOKI excludes all liability (including negligence), for any personal injury; or any loss or damage; whether direct, indirect, special or consequential, arising in any way out of the offer, including any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by HiKOKI NZ) due to any reason beyond the reasonable control of HiKOKI NZ.
  7. HiKOKI may collect and use your personal information to provide you updates on our latest products and services, to analyse and research customer choices on products, to provide products and services you have requested (e.g. extended warranty, the HiKOKI Warranty) and for other purposes relating or incidental to warranty (e.g. warranty registration, product recalls) (“the Purposes”). To do so, HiKOKI NZ may disclose your personal information to its related bodies, business partners or third parties for purposes such as web or data hosting. Some of the recipients are located overseas, including Japan, Australia and Europe. If HiKOKI does not collect your personal information, then it may not be able to fulfill the Purposes. Under the New Zealand Privacy Act, before HiKOKI NZ discloses personal information overseas, it will take such steps as are reasonable in the circumstances to ensure that the overseas recipient does not breach the New Zealand Privacy Act.   1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in HiKOKI’s Social Platform promotion (Facebook and Instagram) is deemed acceptance of these Terms and Conditions.

  3. Entry is only open to New Zealand aged 16 years or over.
  4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.   5. Promotion commences on date stated in the terms and conditions on that Social Media platform post (Facebook and Instagram) and ends on the date specified on that promotional post. (“Promotional Period”).
  6. If a promotion involves users to upload and or post a photo or video, individuals has forfeited their rights to the use of that imagery or video content, and all rights are transferred over to the owner HiKOKI New Zealand to use for marketing purposes without compensation.
  7. Multiple entries are permitted per person if specified, however, if the competition is to provide Photograph or video, each imagery must be unique and each entry must be submitted separately and in accordance with entry requirements.
  8. Incomplete or indecipherable entries will be deemed invalid.
  9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  11. A draw will be conducted by the promoter if applicable to that Promotional Opportunity
  12. The Promoter’s decision is final and no correspondence will be entered into.

  14. The prize will often state a valued at (RRP). The prize will be delivered to the winner’s nominated residential address in New Zealand.
  15. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  16. If a prize (or part of a prize) becomes unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  17. Total prize pool value is often speculated as (RRP) including GST.
  18. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

  20. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to Photographs (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever where it has control of Content. Entrants warrant and agree that:
    1. they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
    2. their Content shall not contain viruses or cause injury or harm to any person or entity;
    3. their Content must not depict any other person, unless they have consent of that person to photograph them;
    4. the Content is the original work of the entrant that does not infringe the rights of any third party;
    5. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act and warrant that they have the full authority to grant these rights; and
    6. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
  21. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates, and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  22. Entrants consent to the Promoter using their name, likeness, image, and/or voice in the event they are a winner (including photograph, film, and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  24. Any cost associated with accessing the Internet in relation to the promotion is the entrant’s responsibility and is dependent on the Internet service provider used.
  25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the consumer guarantees act as provided under the Competition and Consumer Act. The Promoter (including its respective officers, employees, and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a prize.
  27. As a condition of accepting a prize, each winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

The Promoter collects personal information (“PI”) in order to conduct the Promotion and administer and facilitate subscriptions and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. Entry into the Competition

  1. Entry into the Competition is open to New Zealand citizens and New Zealand residents only over 18 years of age.
  2. The Competition commences 6:00am (NZST) Tuesday 1st November 2022 and concludes 11:59 pm (NZST) Tuesday, 31st January 2022 (Closing Date) (the Promotional Period). Please Note: The Competition start date and end date or the entire Promotion Period may be changed at any time and at short notice due to any unforeseen future restrictions enforced by the New Zealand Government in relation to the Covid-19 crisis. The Promoter may also vary the Promotion Period at any time considering the impact of the Covid-19 Pandemic.

To enter, entrants must, during the Competition Period complete the following: Purchase any HiKOKI Power Tool Product, from any Authorised HiKOKI retailers during the promotional period and retain your proof of purchase (receipt). HiKOKI products purchased from non-authorised sellers and retailers (including parallel imports) are not eligible to participate in this Competition. Determining the Winner of the Prize Pack

  1. The prize draw for draw one (1), draw two (2), and draw three (3) for winner(s) will take place at HiKOKI Head Office NZ, 232 Bush Road, Rosedale, Auckland NZ during (2nd week) after the closed date stated in section (7) of these terms and conditions. Winner(s) will be awarded the prize within 6 weeks of the prize draw completed. The winner(s) will be required to provide a physical delivery address where the prize can be delivered by Bulk Carrier (cannot be a Rural Delivery address). In regards to the winner(s) who win the prize of the Samsung 55” Q60B QLED 4K Smart TVs, this will be delivered to the winner(s) physical delivery address by Harvey Normans and their bulk carrier. The Prize of the Samsung 55” QLED TVs does not include delivery to rural addresses, installation, tuning or setting up the Samsung 55” QLED TVs. In no way, Accent Tools take responsibility for goods damages in transit or any additional costs occurred during delivery of these prizes. The winner(s) will be required to provide a physical delivery address to be presented with the prize. If the winner(s) is, through any legal incapacity or otherwise, unable to register the prize in their own name, then the winner may assign the prize to another person (who consents to such assignment) with legal capacity for the purposes of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee.
  2. There will be a total of up to two hundred and seven (207) winners over the 3-month promotional period.

  7. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  8. The Promoter’s decision is final, and the Promoter will not enter into correspondence regarding the Competition result.
  9. The Promoter reserves the right to request the winner(s) to provide proof of identity and proof of residency at the nominated prize delivery address such as drivers license, photo ID, passport and other similar documentation. Proof of identification, residency and entry considered suitable for verification may be requested at the sole discretion of the Promoter. In the event that a winner(s) cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  10. The prize(s) will be awarded to the person named in the entry only unless assigned via the winner(s) (refer to clause 14). Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter and modify their entry as appropriate.
  11. If the winner(s) advises that they do not want to accept the prize, it will be forfeited and awarded to another winner.
  12. Unless expressly stated in these Terms all other expenses become the responsibility of the winner(s).
  13. Once the prize(s) has left the Promoter’s nominated premises, the Promoter and suppliers of the prize(s) takes no responsibility for prize(s) being damaged, delayed or lost in transit. Prize confirmation will be sent out within 28 days. Please allow up to six (6) weeks for prize delivery or collection.
  14. By accepting the prize, the winner agrees to participate in and cooperate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed and/or filmed.
  15. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  16. The winner should seek independent financial advice as tax implications may arise as a result of accepting the prize.
  17. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in clause 10 or is in breach of these Terms.
  18. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize pack and the prize pack supplier’s requirements.

General Conditions

  1. In the case of: – The intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these Terms, including but not limited to vandalism, disease pandemic, power failures, tempests, natural disasters, acts of God, civil unrest, pandemic, strike, war, act of terrorism; or – The Promoter being unable to run the Competition as planned due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter may in its absolute discretion take any action that may be available and it deems appropriate (at its sole discretion), including changing the Promotion Period of the Competition and to cancel, terminate, modify or suspend the Competition.
  2. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize pack except for any liability which cannot be excluded by law (including the Fair Trading Act 1986 and the Commerce Act 1986). The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  3. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms, or engaged in any unlawful or other improper misconduct of the Competition. The Promoter reserves its rights to recover damages or other compensation from such a person.

Collection of Information

  1. In the case of:
    • The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at: here
    • The Promoter is bound by the Privacy Act 1993 and by entering the Competition, an entrant is taken to consent to the Promoter’s Privacy Policy.

In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the New Zealand Privacy Act or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of New Zealand including in Australia and Japan.

Media & Marketing

  1. The prize winner(s) agrees to participate in any news media activities surrounding the Competition. The Promoter reserves the right to use the winner’s name, voice, image and likeness for marketing, advertising and publicity purposes in any media in perpetuity without further reference, payment or other compensation to the winner.
  2. Each entrant also consents to the Promoter using their personal information for future marketing purposes, unless otherwise advised by the entrant.

Tax

  1. Any tax liability arising as a result of accepting the prize is the responsibility of the winner

Governing Laws

  1. The laws of New Zealand apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New Zealand
